Nfin8 Hearts

Where we serve: Crown Point, IN, with events across Northwest Indiana & Chicagoland
1) Who we are & What this is
Nfin8 Hearts creates guided, joyful play experiences where parents and kids participate together. These Terms govern bookings, payments, attendance, and use of our site/services. By booking, paying a deposit, or attending an event, you agree to these Terms.

2) Bookings, deposits, and payments
Deposit: A 50% deposit secures your date. Deposits are non-refundable but transferable once within 60 days (see Reschedule below).
Balance: Due 48 hours before the event start. If unpaid, we may release the date.
Payment methods: Square Online Checkout (cards), checks by prior approval only.
Travel: Events more than 20 miles from Crown Point, IN incur $1.50/mi round-trip.
Taxes/fees: If applicable, host/organizer is responsible for local taxes or venue fees.
Chargebacks: Filing a chargeback without contacting us first may result in a service hold until resolved.

3) Pricing & what’s included
Each booking includes: trained staff, event flow, core play stations (e.g., parachute, bubbles, chalk), setup (~45 min), cleanup (~30 min), a basic sound setup, and a simple promo toolkit for hosts. Add-ons (extra staff, photo capture, custom signage, tent, lighting) are available by quote.
4) Reschedule, cancellation, & weather
Organizer reschedule: One no-fee reschedule within 60 days when requested ≥7 days before the event (subject to availability).
Organizer cancel:
≥7 days before: deposit transferable once (60-day window).
<7 days before or no-show: deposit forfeited.
Weather (outdoor events): We make a joint decision by 8:00 AM day-of. If unsafe (storms, high winds, extreme temps), you may:
Move indoors, or
Reschedule within 60 days (no fee).
Our cancellation: If we must cancel (e.g., staff illness, emergency), you may choose a full refund or no-fee reschedule.

5) Space, access, and host responsibilities
To keep things safe and smooth, the host agrees to:
Provide a clean, open area (gym, cafeteria, multi-purpose room, or flat outdoor space) with clear entry, restrooms, and standard power.
Ensure early access 45 minutes before start; unlock/lockup coordination; parking/loading info.
Maintain a safe environment (dry floors, hazard-free paths); alert us to venue rules (sprinklers, tape, noise, occupancy).
Observe posted capacity; overcrowding may require activity adjustments for safety.
Be the on-site point of contact during the event.
Venue approvals and permits (if any) are the host’s responsibility.
6) Safety, supervision, and conduct
Family participation: Our events are designed for kids with their parent/guardian present. We are not childcare.
Supervision: Adults must supervise the children they bring and follow staff guidance and boundaries.
Inclusive play: We welcome all abilities/ages; tell us about accessibility needs ahead of time and we’ll adapt.
Health & first aid: We provide basic first-aid supplies; we don’t provide medical care. If anyone is ill or injured, alert staff and seek appropriate care.
Prohibited items: No smoking/vaping, alcohol, or weapons in the play zone.
Property: We aren’t responsible for lost or stolen personal items.
We may modify or pause activities if we see safety concerns.
7) Photos, video, and media
We often capture moments (photos/video) to share with families and demonstrate impact.
Opt-out: If you prefer no photos, tell us at check-in; we’ll provide a visible opt-out sticker and avoid capturing you/your family.
Hosts: Please inform attendees ahead of time (we can provide template language).
Removal: If we inadvertently share your image and you want it removed, email us and we’ll take it down.
Illinois note (BIPA): We do not collect biometric identifiers (e.g., facial scans). No facial recognition; ordinary photos are not used to create biometric templates.

8) Insurance, liability, and risk
Insurance: We carry general liability insurance; Certificates of Insurance (COI) available upon request.
Assumption of risk: Active play carries inherent risks (slips, trips, bumps). By attending, participants (and guardians for minors) assume ordinary risks associated with these activities and agree to follow staff instructions.
Venue/host conditions: The host is responsible for the condition of the venue and any hazards unrelated to our equipment/operations.
Damages: The host is responsible for damages caused by attendees to the venue. We’re responsible for our own equipment.
To the fullest extent permitted by law, Nfin8 Hearts is not liable for indirect, incidental, or consequential damages. Nothing here limits liability where not permitted by Indiana/Illinois law.
9) Indemnification
To the extent permitted by law, the host/organizer agrees to indemnify and hold harmless Nfin8 Hearts and its staff from claims arising out of: (a) the host’s venue conditions or failure to follow safety guidance; (b) violations of venue rules; or (c) unauthorized changes made by the host. This doesn’t apply to our own negligence or willful misconduct.
10) Force majeure
Neither party is liable for delays or failures caused by events beyond reasonable control (e.g., severe weather, power outages, public health orders, strikes). In such cases, we’ll work in good faith to reschedule.
11) Compliance (Indiana & Illinois)
We follow applicable local rules for occupancy, noise, and safety. The host ensures venue compliance and any required permits.
Breach notifications: If a data incident affects your personal info, we’ll notify you consistent with Indiana and Illinois requirements.
Background checks: If your organization requires staff checks or badges, tell us in advance so we can coordinate.
12) Governing law & venue
Events in Indiana: Governed by Indiana law; exclusive venue in state or federal courts in Lake County, Indiana.
Events in Illinois: Governed by Illinois law; exclusive venue in state or federal courts in Cook County, Illinois.
13) Disputes & good-faith resolution
If a concern arises, we’ll both try to resolve it informally first. If we can’t, the governing law/venue above applies.
14) Changes to services or terms
We may update offerings or these Terms. The effective date above shows the latest version. Material changes will be noted on this page.
15) Acceptance
By booking, paying a deposit, or attending an event, you confirm you’ve read and accepted these Terms, and—if you’re a parent/guardian—you accept on behalf of participating minors in your care.
